DATA PROTECTION POLICY
IN FRACTAL MIND SP. Z O.O.

In order to implement the principles of legality, reliability and transparency of the processing of the clients’ personal data using the services offered by Fractal Mind sp. z o.o. with its registered seat in Poznań, we provide you with Data Protection Policy, which defines the principles based on which Fractal Mind sp. z o.o. processes personal data of the clients as well as clients’ rights regarding processing of their personal data.

1. DATA CONTROLLER

You can contact the Data Controller throughout the information indicated on the Data Controller’s website.

2. PURPOSES OF DATA PROCESSING

Your personal data are processed by the Data Controller in order to:
1) Fulfill an agreement
Personal data is processed in connection with graphic performance in order to fulfill agreements concluded with the clients or as part of the activities prior to the conclusion of the agreements (e.g. contact via e-mail).
2) Fulfill the legitimate interests of the Data Controller
The Data Controller has the right to process your personal data in order to fulfill its legitimate interests. It means that each purpose in which the Data Controller is processing your personal data on this basis is legal. Complying with the Data Controller’s legitimate interests is processing of your personal data in the following purposes: transferring your personal data to the entity responsible for the Data Controller’s bookkeeping, answering to your requests and questions asked via e-mail, telephone or social media, handling your complaints, archival (evidential) in order to secure the data in case of a legal need to prove certain facts (e.g. before tax authority), potential determination, investigation or defense against claims, offering to you products and services by the Data Controller (direct marketing). If processing of your data has no legal basis in one of the above mentioned purposes the Data Controller will be entitled to process your personal data only if you give your consent. Individual consent requires in particular processing by the Data Controller you personal data in purpose of direct marketing of the products and services of the Data Controller fulfilled by: sending you commercial information by means of electronic communication (e.g. by sending commercial offer on your e-mail,) contacting you using telecommunication equipment and automatic calling systems (e.g. by presenting a commercial offer during a telephone conversation).

3. RETENTION PERIOD OF PERSONAL DATA

Your data will be processed for a period of time necessary for completion of the processing purposes:

  • - in scope of completion of the order – until the time of completion of the order and after this time for a period required by law or for possible civil-law claims,
  • - in the remaining situations - until you effectively oppose against processing of your data by the Data Controller.

4. TRANSFERRING PERSONAL DATA TO OTHER ENTITIES, COUNTRIES OR INTERNATIONAL ORGANIZATIONS.

The Data Controller does not transfer personal data outside Poland, European Union and European Economic Area.

5. RIGHTS REGARDING PROCESSING OF YOUR PERSONAL DATA

Due to processing of your data by Data Controller you have the rights indicated in GDPR, in particular:

  • - The right to access your personal data as well as its rectification, erasure and restriction of processing,
  • - The right to object processing of you data as well as its transmission to other entities,
  • - The right to change or withdraw your consent at any time with the provision that withdrawal of your consent will not have effect on compliance with the law of the processing which took place on the basis of the consent given before its withdrawal
  • - The right to file a complaint to the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych).

6. PROCESSING SECURITY

The Data Controller processes your personal data with the utmost diligence and in a manner that secures this data from the access of unauthorized persons, using technical, programming and organizational security methods.

W celu realizacji zasady zgodności z prawem, rzetelności oraz przejrzystości przetwarzania danych osobowych osób korzystających z usług oferowanych przez Fractal Mind sp. z o.o. z siedzibą w Poznaniu, przekazujemy Państwu niniejszą Politykę Prywatności, która określa na jakich zasadach Fractal Mind sp. z o.o. przetwarza dane osobowe swoich klientów oraz jakie prawa przysługują tym klientom w związku z przetwarzaniem ich danych osobowych.

2. CELE PRZETWARZANIA DANYCH OSOBOWYCH

Państwa dane osobowe przetwarzane są przez Administratora w celu: 1) Wykonania umowy i realizacji zlecenia
Dane są przetwarzane w związku z wykonywaniem działalności graficznej, w ramach realizacji umów zawartych z klientami (np. realizacja zlecenia) lub w celu realizacji działań przed zawarciem umowy (np. kontakt mailowy).
2) Realizacji prawnie uzasadnionych celów Administratora lub osoby trzeciej Administrator ma prawo przetwarzać Państwa dane osobowe w celu realizacji prawnie uzasadnionych interesów Administratora. Oznacza to, że cel w którym Administrator przetwarzał będzie Państwa dane osobowe na tej podstawie, jest zgodny z prawem. Zgodne z realizacją prawnie uzasadnionych interesów Administratora lub osoby trzeciej jest przetwarzanie Państwa danych osobowych w celu: przesyłania Państwa danych osobowych do firmy prowadzącej księgowość Administratora odpowiadania na Państwa zapytania mailowe, telefoniczne oraz zadane przy użyciu social mediów, rozpatrywania reklamacji, archiwalnym (dowodowym) dla zabezpieczenia informacji na wypadek prawnej potrzeby wykazania określonych faktów (np. przed organem podatkowym), ewentualnego ustalenia, dochodzenia lub obrony przed roszczeniami, oferowania Państwu przez Administratora produktów lub usług (marketing bezpośredni). Jeżeli przetwarzanie Państwa danych osobowych nie ma podstawy prawnej w jednym z ww. celów Administrator będzie mógł przetwarzać Państwa dane osobowe wyłącznie w sytuacji, gdy uprzednio wyrażą Państwo na to zgodę. Odrębnej zgody wymaga w szczególności przetwarzanie przez Administratora Państwa danych osobowych w celu marketingu bezpośredniego produktów lub usług Administratora realizowane poprzez: wysyłanie Państwu informacji handlowych za pomocą środków komunikacji elektronicznej (np. poprzez przesłanie oferty handlowej adres e-mail podany przez Ciebie w formularzu rejestracyjnym) kontaktowanie się z Państwem przy użyciu telekomunikacyjnych urządzeń końcowych i automatycznych systemów wywołujących (np. poprzez przedstawienie oferty handlowej podczas rozmowy telefonicznej)

3. OKRES PRZECHOWYWANIA DANYCH OSOBOWYCH

Państwa dane będą przetwarzane przez okres niezbędny do realizacji celów przetwarzania:

  • w zakresie realizacji zlecenia – do czasu zakończenia jego realizacji, a po tym czasie przez okres wymagany przez przepisy prawa lub dla realizacji ewentualnych roszczeń cywilnoprawnych,
  • w pozostałym zakresie - do momentu skutecznego wniesienia przez Państwa sprzeciwu wobec przetwarzania danych osobowych.

4. PRZEKAZYWANIE DANYCH OSOBOWYCH DO INNYCH PODMIOTÓW, DO PAŃSTW TRZECICH LUB ORGANIZACJI MIĘDZYNARODOWYCH.

Administrator nie przekazuje Państwa danych osobowych poza teren Polski, Unii Europejskiej oraz Europejskiego Obszaru Gospodarczego.

5. PAŃSTWA UPRAWNIENIA ZWIĄZANE Z PRZETWARZANIEM DANYCH OSOBOWYCH

W związku z przetwarzaniem danych osobowych przez Administratora przysługują Państwu uprawnienia wynikające z RODO a w szczególności:

  • prawo dostępu do swoich danych osobowych oraz ich sprostowania, usunięcia lub ograniczenia przetwarzania,
  • prawo do wniesienia sprzeciwu wobec przetwarzania danych lub przekazania danych innym podmiotom,
  • prawo do wycofania w dowolnym momencie udzielonej wcześniej zgody na przetwarzanie danych w zakresie, jakiego dotyczy ta zgoda, z tym zastrzeżeniem, że wycofanie zgody nie będzie miało wpływu na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej wycofaniem
  • prawo do wniesienia skargi do Prezesa Urzędu Ochrony Danych Osobowych.

6. OCHRONA DANYCH OSOBOWYCH

Administrator przetwarza Państwa dane osobowe z zachowaniem najwyższej staranności oraz w sposób który zabezpiecza dostęp do nich osobom nieupoważnionym wykorzystując zarówno techniczne, programistyczne, jak i organizacyjne metody zabezpieczeń.
